Medical Leave

For those times when you need to be absent from work for medical reasons, VMware provides time off to recover, in accordance with statutory requirements, and when approved by Social Security.

Eligibility

Regular full-time and part-time employees who are directly employed by VMware.

Short Term Disability

  • Conditions for receiving benefits: total disability (66%)
  • Disability Benefits, according to the Labor Law (LCT):
    • If you have less than five (5) years of service, VMware will maintain your full income for three (3) months (six (6) months for those with families).
    • If you have more than five (5) years of service, VMware will maintain your full income for three (6) months (six (12) months for those with families).

Long Term Disability

  • Conditions for receiving benefits: total disability (66%)
  • Disability Benefits
    • Non-occupational Total Provisional Long Term Disability: Upon declaration of the Long Term Disability and during the following thirty-six (36) months, the disability is considered provisional. This period can be extended for another twenty-four (24) months. During this provisional period, the social security system guarantees total disability benefits.
    • Non-occupational Total Permanent Long Term Disability: The benefit is 70% of base income, plus family allowances. Once the provisional period ends, the Long Term Disability is considered permanent. If it is a work-related disability, you are entitled to ART benefits.

Worker’s Compensation

For Short Term Disability that derives from an occupational accident or work-related sickness, ART fully insures benefits. From the first day after the disabling event and throughout the disability period, you receive a monthly payment equal to the amount of your monthly salary at the time of the event (including benefits in kind plus family allowances).

Scheduling Medical Leave

You must immediately provide your Medical Leave documentation to VMware to ensure your Medical Leave is appropriately captured and paid. Send your documentation to the Payroll Team, and your direct manager, as soon as possible. Failure to timely report your Medical Leave may lead to payment discrepancies.
